“LIFE ON BLACKBERRY” PRIZE DRAW
TERMS AND CONDITIONS
Participants agree to be bound by these Terms and Conditions. These terms and conditions will apply to the “Life on BlackBerry” Prize Draw (“Promotion”), during the Promotion Period stated below. By entering this Promotion you are deemed to have accepted these Terms and Conditions and any applicable Promotion notices (together the “Terms and Conditions”). These Terms and Conditions will have priority over any inconsistent terms in any applicable Promotion notice.
- PROMOTION PERIOD
The Promotion will commence at 10,00(SST) on 22 July 2009 and close at 20.00(SST) 26 July 2009 (the "Promotion Period").
You are eligible to participate in the Promotion if you are a legal resident of Singapore and have reached the age of eighteen (18) as at the date of entry.
Employees of Research In Motion Singapore Pte. Limited ("RIM"), and its affiliated companies and advertising and promotional agencies, representatives and entities involved in the implementation and execution of the promotion and their immediate family members (parents, children, siblings and spouses) are not eligible to participate.
- HOW TO ENTER
To enter all participants must purchase an eligible BlackBerry device at the designated area at the “Live Life on BlackBerry” road show at Mid Valley Megamall, Kula Lumpur (the “Venue”) during the Promotion Period. To be entered into the draw participants will be required to complete an entry form containing their contact details and the IMEI and PIN number of the eligible BlackBerry device purchased during the Promotion Period [The entry form must be deposited in the “Life on BlackBerry” entry box at the Venue].
Non-compliance with the entry procedure and requirements will result in disqualification. Only one entry per BlackBerry device purchased. The deadline for all entries is 20.00 (SST) 26 July 2009. All entries become the property of Promoter and will not be acknowledged or returned.
- HOW TO WIN AND PRIZES
Prize allocation for random Prize Draw
Prize shall be a cash voucher (approximate retail value RM4000.00) which shall be redeemable against, as selected by the prize provider (the “Prize”). All prizes are valued in Ringgit Malaysia. The Prize shall be subject to further terms and conditions. The draw will be conducted at Mid Valley Megamall, Kula Lumpur, by a representative or agent of the Promoter whose decisions are final and binding.
The odds of winning a prize in the Promotion depends on the number of valid entries in the draw.
- DRAWING AND PRIZE NOTIFICATION
The drawing will be conducted at 20.30 (SST) 26 July 2009 from among all eligible entries received during the Promotion Period.
Winners will be notified by email or telephone using the email address or telephone number provided. If, for any reason a winner cannot be reached using the email address or telephone number provided within ten (10) business days of the closing date of the Promotion or the winner fails to comply with any Promotion requirements in these Terms and Conditions the prize will be forfeited and the Promoter reserves the right to randomly select another winner from the remaining eligible entries.
If the prize cannot be allocated after 5 redraws from the remaining eligible entries RIM reserves the right to donate the prize to a charitable organisation of RIM’s choice.
The winner will be required to collect the prize from RED Movements Sdn Bhd at 19A Jalan Anggerik Vanilla N31/N, Kota Kemuning 40460 Shah Alam, Selangor.
- GENERAL CONDITIONS
The validity of any entry is subject to verification by the Promoter. Any illegible, incomplete or fraudulent entries will be disqualified.
6.2 Limitation of Liability – General
By participating in this Promotion, you agree, to the maximum extent permitted by the applicable law, to release and hold Promoter(s) and promotion administrators and their respective parent companies, affiliates, subsidiaries, officers, directors, agents, and employees (collectively, “Released Parties”), harmless from any and all liability whatsoever for any injuries, losses or damages of any kind arising from participation in or in connection with the Promotion, including, without limitation: (i) awarding, acceptance, receipt, possession, use and/or misuse of the Prize awarded herein; or (ii) participation in any related activities and travel of any kind. The above limitation of liability shall not apply to death or personal injury caused as a result of Promoter’s negligence.
6.3 Limitation of Liability – Promotion Operation
By entering the Promotion and to the maximum extent permitted by applicable laws, you release and discharge Released Parties from any and all liability resulting from: (i) late, lost, delayed, stolen, misdirected, unreadable, incorrect, inaccurate, garbled or unintelligible communications, including without limitation, entry information, regardless of the method of transmission, including the failure to send a prize notification email and/or shipping of prize to the prize winner; whether caused by website users or by any of the equipment or programming associated with or utilized in the Promotion; (ii) any error, omission, interruption, deletion, defect, or delay in operation or transmission at any website related to the Promotion, or for communications line failure, or for theft or destruction, tampering, or unauthorized access to entries and/or entry information; (iii) printing, human, typographical or other errors in any Promotion material or the administration of the Promotion; (iv) any computer, software, website or electronic defect, error or failure regardless of reason.
6.4.1 Promoter reserves the right, in its sole discretion, to disqualify any individual it finds to be:
- a) tampering with the operation of the Promotion or any website related to the Promotion;
b) to be acting in violation of the Terms and Conditions; or
c) to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any person participating in or connected with the Promotion.
6.4.3 In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized account subscriber of the email account used to enter the Promotion at the actual time of registration will be deemed to be the participant and must comply with the Terms and Conditions; the unauthorized subscriber(s) will be disqualified. For the purpose of these Terms and Conditions, the authorised account subscriber is deemed to be the natural person who is assigned an email address by an internet access provider, online service provider or other organisation, which is responsible for assigning email addresses for the domain associated with the submitted email address.
6.4.4 Winner may be required to provide Promoter with proof of identity or that they are the authorised account holder of the email address associated with the winning entry.
6.4.5 All decisions of the Promoter with respect to any aspect of the Promotion, including the eligibility or disqualification of entrants, are final, without right of appeal. If relevant, the Promoter’s server shall be the official time stamp for the purposes of determining the validity of any entries by entrants.
The Promoter reserves the right to modify, terminate or suspend the Promotion in whole or in part, in its sole discretion in the event of a computer virus, a computer bug, tampering, unauthorized human intervention, fraud, technical or other failure or any other cause or act beyond the control of the Promoter that could affect the administration, operation, security and fairness, integrity or proper conduct of the of the Promotion. In the event such an occasion arises the Promoter will post a notice at http://www.blackberry.com/ap/events/.
6.6 Acceptance and Substitution of Prize
Prize(s) are non-transferable and not redeemable for cash by winners. In the unlikely event that prizes offered are discontinued or otherwise unavailable, the Promoter reserves the right to deliver a prize of equal or greater value. In the event of an error in the operation of the Promotion resulting in more winners than prizes, Promoter reserves the right to allocate the Prize(s) to the winners by way of a random draw amongst such winners or to divide the value of the Prize(s) amongst such winners.
The winner will be solely responsible for any and all applicable taxes and any other costs, expenses and fees resulting from acceptance of a prize which are not stated in these Terms and Conditions.
6.8 USE OF THE PRIZE(S)
6.8.1 The prize shall only be valid for a year.
6.8.2 You acknowledge and agree that:
a) the use of the third party products and services is subject to the terms and conditions, including, if applicable, any license agreement, provided with the third party software, hardware, products, and/or services (collectively, the "Third Party Information").
b) Your use of Third Party Information shall be governed by and subject to your agreement to the terms of separate Third Party Information licenses and/or agreements, if any.
c) any Third Party Information that is provided with or without Promoter's products and/or services is provided "as is". Promoter makes no representation, warranty or guarantee whatsoever in relation to the Third Party Information and Promoter assumes no liability whatsoever in relation to the Third Party Information even if Promoter has been advised of the possibility of such damages or can anticipate such damages.
d) the inclusion of Third Party Information herein does not imply endorsement by Promoter of the Third Party Information or the third party in any way.
e) the Promoter does not control and is not responsible for any Third Party Information, including without limitation, the content, accuracy, intellectual property issues, compatibility, performance, trustworthiness, legality, decency, links, or any other aspect of the Third Party Information.
Winners may be requested to take part in promotional activity, the Promoter shall only use the name (excluding announcement of winner’s name as part of administration of Promotion), voice, likeness and/or image of the winners in any publicity, advertising, trade or other promotional activity upon obtaining prior written consent.
6.10 Personal Information
6.11 Governing Law
These Promotion Terms shall be governed by and construed under the laws of the Republic of Singapore, and any dispute under these Promotion Terms shall be subject to the non-exclusive jurisdiction of the courts of the Republic of Singapore.
6.12 Winners’ Names and Terms and Conditions
For the names of the winners, mail a self-addressed stamped envelope to RED Movements Sdn Bhd at 19A Jalan Anggerik Vanilla N31/N, Kota Kemuning 40460 Shah Alam, Selangor. Please include the name of the promotion as a reference. For a copy of these Terms and Conditions, send a self-addressed stamped envelope to at the same address.
